1. What this Service is

XingAI Invest AI ("the Service") provides AI-generated market analysis, news summaries, and educational tools. It is intended solely for informational and educational purposes.

2. No Investment Advice

XingAI Invest AI is NOT a registered investment advisor (RIA), broker-dealer, or fiduciary. We do not provide personalized investment advice. Nothing on this site or in this Service constitutes a recommendation to buy, sell, or hold any security, nor an offer or solicitation of any transaction in any financial instrument.

3. AI-Generated Content May Be Wrong

AI-generated content may be inaccurate, incomplete, biased, or out of date. You should not rely on it for any investment decision. Models used by the Service may produce different outputs for the same input, may hallucinate facts, and may reflect biases present in their training data.

4. Investment Risk

Past performance is not a guarantee or indicator of future results. All investments carry risk, including the risk of total loss of principal. Markets are unpredictable and the Service makes no representation about future performance of any security or market.

5. Your Responsibility

You are solely responsible for evaluating the merits and risks of any investment, and for all decisions you make. Consult a licensed financial professional before acting on any information provided by the Service.

6. No Warranties (AS-IS)

The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, timeliness, or completeness. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

7. Limitation of Liability

To the maximum extent permitted by law, in no event shall XingAI, its affiliates, officers, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages — including but not limited to damages for loss of profits, trading losses, goodwill, use, data, or other intangible losses — arising out of or related to your use of, or inability to use, the Service.

Our total cumulative liability for any and all claims arising from or related to the Service shall not exceed the greater of one hundred US dollars ($100) or the amount you have paid us in the twelve (12) months preceding the claim.

8. Indemnification

You agree to defend, indemnify, and hold harmless XingAIand its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including any intellectual property right; or (d) any investment decision you make based on information from the Service.

9. Voluntary Tips and Support Payments

From time to time we may offer an optional way to make a voluntary payment (a "Tip", "Support", or similar label) through a third-party payment processor (currently Stripe). These payments are entirely optional; the Service remains usable without them.

Tips are voluntary contributions to help cover development and operating costs (for example, market data feeds and hosting). They are not charitable donations for tax purposes, not the purchase of investment advice, research, trading signals, portfolio management, or any other financial product or service from XingAI Invest AI, and they do not create a broker-client, advisory, or fiduciary relationship.

Unless we publish a separate written offer clearly tied to your payment at checkout, a Tip does not grant you a subscription, membership, priority support, additional AI analyses, custom symbol slots, or any other feature or entitlement. If we later offer paid plans, those plans will be governed by separate terms presented at checkout.

Tips are processed by the payment processor; we do not collect or store your full payment card details. Tips are generally non-refundable except where required by applicable law or where we expressly state otherwise at checkout. Disputes and chargebacks are handled under the processor's and your card issuer's policies.

By submitting a Tip, you represent that you are authorized to use the payment method provided. Tips may be treated as business income to XingAI. We do not provide tax advice regarding your payment.

Nothing in this section modifies Sections 2–5 above: XingAI Invest AI still does not provide investment advice, and you remain solely responsible for your investment decisions.

10. No Fiduciary Relationship

Your use of the Service does not create any fiduciary, advisory, agency, or broker-client relationship between you and XingAI. We owe no fiduciary duty to you in connection with the Service.

11. Changes to These Terms

We may modify these Terms at any time. The current version will always be available at this URL. Material changes will be highlighted at the top of this page. Your continued use of the Service after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-law principles. Any dispute arising out of or relating to the Service shall be resolved exclusively in the state or federal courts located in California, and you consent to the personal jurisdiction of those courts.
